Addition to ABT06
In complex contracts relating to the construction of process facilities, where the procurement concerns both construction and civil engineering work as well as equipment, it is necessary for the contractor to be given process and functional responsibility.
In these contracts, the Water Industry can conclude that the risks and costs in the entire supply chain generally increase when the procurement contract is based on one of the most widely used standard agreements in the field on the market, ABT 06 or ABA 99, without additions or amendments that specifically take into account the extended process and functional responsibility.
In order for the client to receive a final product of the correct and expected quality, at the right time and at the right price, the Water Industry therefore recommends that ABT 06 be used as the basis for the contract, but with a number of additions/amendments, which are taken from, among other things, ABA 99, which are deemed to be suitable for achieving the above-mentioned purposes.
Against this background, the water industry has produced this ”Water Industry Supplement/Amendments to ABT 06”. The supplements and amendments are intended to ensure that the inspection procedures specified in ABT 06 in the Administrative Regulations, drawn up in accordance with AMA AF 21, are supplemented with rules on inspection, testing, adjustment and trial operation.
To ensure that the agreed function and performance are achieved, regulations on performance compensation/performance penalty are also proposed.
The proposed amendments/changes are used as a starting point for the separable parts of the contract, such as specific technical description, which includes process equipment. Other parts, such as construction, plant and property technical installations, can, in the respects proposed by these amendments/changes, be regulated by ABT 06 without amendments and changes. Under the respective code with proposed changes below, the amendments/changes can thus be limited to the type of technology that includes process, by reference to specific technical description.
The proposed changes and additions specified in the document must be assessed from contract to contract, in terms of amount (performance compensation/penalty) and scope of the additions/changes.
